Florida father charged with manslaughter after his baby son dies more than three years following aggravated child abuse
(VOLUSIA COUNTY, FL) A baby boy has died more than three years after the infant was first rushed to the hospital with catastrophic injuries inflicted upon hm by his father. Prosecutors have now upgraded the case against the child’s father following the child’s death – and after a medical examiner’s ruling that the infant’s death was a homicide.
The Volusia Sheriff’s Office announced Friday that 34-year-old Malcolm Nelson of Orlando has been charged with aggravated manslaughter in the death of his son, Noah Nelson, who died earlier this year after spending more than three years on life support and later in hospice care.
According to investigators, Noah was hospitalized in January 2023 with severe traumatic injuries when he was just three months old. Medical personnel determined the infant had suffered multiple fractures and injuries consistent with physical abuse, including violent shaking. Detectives launched an extensive investigation that led to Nelson’s arrest in October 2023 on a charge of aggravated child abuse.
Authorities said the injuries left Noah in a vegetative state, and he never regained meaningful neurological function. He remained on life support until April 2026, when he was transferred to hospice care at home. He died several days later at the age of 3½ years.
Throughout Noah’s prolonged hospitalization, the Volusia Sheriff’s Office Major Case Unit remained in close contact with the Medical Examiner’s Office and the Office of the State Attorney for Florida’s 7th Judicial Circuit, anticipating additional charges if medical findings supported a homicide determination.
That determination came this week.
The Volusia County Medical Examiner’s final report concluded that Noah’s death was a homicide, identifying the cause of death as complications of abusive head trauma, clearing the way for prosecutors to pursue more serious criminal charges.
Nelson had previously pleaded no contest to aggravated child abuse and was sentenced to 180 days in jail, followed by two years of community control and 13 years of probation.
Earlier this week, deputies arrested Nelson at his probation office on a probation violation. While he remained in custody at the Volusia County Branch Jail, detectives obtained and served a new warrant charging him with aggravated manslaughter in connection with Noah’s death.

The case remains active as prosecutors move forward with the upgraded charge.
